Oleksandr Dubinskyi is a close associate of oligarch Igor Kolomoyskyi, who is

under investigation by NABU in Ukraine and FBI in the US for alleged embezzlement of $5 bln from Privatbank. Mr. Dubinskyi is using his powers as an MP to protect the oligarch's interests. By initiating certain legislative proposals and spreading disinformation at 1+1 TV channel as well as his social media channels Mr. Dubinsky constantly attacks institutions and people, who harm Igor Kolomoyskyi.

INTERFERING IN THE US ELECTIONS

Mr. Dubinskyi is working closely with Andriy Derkach, another Ukrainian MP, who is considered by the USA as a Kremlin agent "maintaining close connections with the Russian Intelligence Services" and therefore designated on September 10, 2020 to the OFAC sanctions list for "his efforts to influence the 2020 U.S. presidential elections".

On October 10, 2019 jointly with Andriy Derkach Mr. Dubinskyi initiated establishment of parliamentary temporary commission with a goal to investigate activities of Valeria Gontaryeva, former head of the National Bank of Ukraine, Nataliya Yaresko, former Minister of Finance of Ukraine, as well as spending

5.3 bln USD of American technical assistance to Ukraine. The commission was not established, but Dubinskyi and Derkach in their letters to American senior officials were referring to this initiative.

On November 20, 2019 Oleksandr Dubinskyi conducted a joint press-conference with AndriyDerkach spreading disinformation against one of the US presidential candidates. 

On December 2, 2019 Oleksandr co-signed with Andriy Derkach letters to Lindsey Graham, Mick Mulvaney and Devin Nunes attacking American technical assistance projects in Ukraine and blackmailing pro-reform Members of Ukrainian parliament as "grant eaters" and "Soros children"


 

On December 4-6, 2019 Rudy Giulliani met in Kyiv with Oleksandr Dubinskyi and Andriy Derkach to collect "facts" about alleged wrongdoings of Joe Biden in Ukraine.

on July 2020 House Speaker Nancy Pelosi referred to the letters from Derkach and Dubinsky as part of foreign plot to damage presidential candidate Joe Biden.

On August 7, 2020 William Evanina, Head of United States National

Counterintelligence and Security Center, mentioned activities of Andriy Derkach as an example of Russian attempts to discredit candidate Joe Biden ahead of the US presidential elections.

The public rhetoric of Oleksandr Dubinskyi goes in line with the Kremlin anti-Western playbook spread by Kolomoysky owned 1+1 channel and three national TV channels of the most influential Kremin agents in Ukraine Viktor Medvedchuk.

ASSETS IN UKRAINE

Before entering parliament in August 2019 within the "Servant of the People" faction Oleksandr Dubinskyi made his fortune at 1+1 TV channel owned by oligarch Igor Kolomoyskyi. He worked there since 2010 as a producer of investigative content and than since 2014 as anchor of "Money" TV program, which he frequently used to spread fakes and other non-verified media content aimed to blackmail enemies of Igor Kolomoyskyi.

In his interview in June 2019 Oleksandr Dubinskyi claimed his salary at 1+1 channel was close to 72 thousand UAH per month (approx 2785 USD). He also claimed receiving at least $3500 monthly income from YouTube due to the popularity of his youtube channel and some income from renting real estate. Before his career at 1+1 channel Oleksandr Dubinskyi was working in 2004-2009 as a reporter in the newspaper "Economicheskiye Izvestiya" and in 2009- 2010 as chief editor of Weekly.ua online magazine.

Despite stated relatively modest official income from his journalistic career Oleksandr Dubinskyi acquired in 2014- 2020 wealth worth millions of dollars, and part of the assets he fails to declare.

INTELLECTUAL PROPERTY RIGHTS

  • - ownership of youtube DubinskyPro registered on 17.01.2017. As of September 2020 the channel has 340 000 subscribers and 109,643,929 views, however Dubinsky doesn't declare any income generating from youtube traffic. Oleksandr Dubinskyi regularly produces video content for his youtube blog since he became the Member of Parliament and continues to provide content to 1+1 TV channel.
  • - 3 trademarks, two of which were registered in Autumn 2019.

PRESENTS AND SECURITY 

  • 3 car presents from his mother Berezovska Alla with declared value: 345 832 UAH (approx 13400 USD), 1 123 632 UAH (approx 43500 USD), 1 261 098 UAH (approx 48800 USD) respectively.
  • Oleksandr Dubinskyi also declared 360 000 UAH (approx 14 000 USD ) expenses for his personal bodyguards to the security firm "Security" LLC. The company is affiliated with Igor Kolomoyskyi.

UNEXPLAINED WEALTH OWNED BY WIFE AND MOTHER

On November 11, 2019 investigative journalists from "Bihus.info" reported that Oleksandr Dubinskyi, his retired mother Alla Berezovska and wife Lesya Tsybko have possessed 24 apartments in Kyiv (most of them are luxury apartments in Kyiv downtown), 2 houses (in Kyiv and Kyiv suburbs), 17 cars (most of them are luxurious and/or collection cars), many parking lots. Journalists estimated the overall value of these assets at least 2.5 mln USD.

Mr. Dubinskyi in his public response to the investigation was not able to explain the origin of this wealth. 

According to the state registry of movable and immovable property in late December 2019 Mr. Dubinskyi presented as a gift to his mother 7 cars and 3 apartments, as well as one car to his wife. Most likely he made this transfer of ownership to avoid declaring significant unexplained assets.

-70,4 sq metres apartment (market value $88 000), purchased by Mr. Dubinskyi on December 28, 2015 103,5 sq metres apartment on Naberezhna Khreshchatytska 1 near Fairmont Grand Hotel in downtown Kyiv (approx value 250 000$), purchased by Mr.Dubinskyi on December 9, 2014

In addition to these apartments presented by her son in late 2019 Alla Berezovska is registered as an owner of 12 apartments in downtown Kyiv (6 of which she purchased in 2019), 4 parking boxes at downtown Kyiv with total 252 sq metres, 1 land plot in Kyiv suburbs, specifically:

Lesya Tsybko is publicly known as a wife of Oleksandr Dubinskyi, however, he does not declare her assets despite requirements of the law.

Lesya Tsybko worked as marketing director at NGO "Ligue of financial development", which is mentioned in the asset declaration of Oleksandr Dubinsky. Mr. Dubinskyi founded this NGO in 2009 jointly with Borys Timonkin, a close associate of oligarch Sergii Kurchenko, who fled to Russia in 2014 and is suspected in embezzlement of hundreds millions dollars in Ukraine.

Lesya Tsybko owns 7 apartments in Kyiv and one car - all acquired between 2015-2020 years, specifically:

On December 27, 2019 Mr. Dubinskyi presented to his wife Lesya Tsybko Mercedes- Benz, GLK 350, 2009.

On February 8, 2020 Oleksandr Dubinsky at his youtube channel announced charitable auction of what he called "collection of his cars", which in fact were owned by his mother, specifically:

3 cars Mr. Dubinskyi presented to his mother in December 2019 (Mercedes-benz W202 AMG C36, 1997, Mercedes-benz W124 AMG 6.2, 1991, Mercedes-benz CL 140, 1996)

2 cars obtained by Mr. Dubinskyi's mother in 2017 from unknown sources (BMW E39 M5, 2003 , BMW E31 850, 1991)

There are strong reasons to believe that Mr. Dubinskyi remains a beneficial owner of real estate and cars, which are officially owned by his retired mother and his wife.

There is strong evidence suggesting Oleksandr Dubinskyi uses his mother Alla Berezovska to legalize income he received from unexplained sources and from which he did not pay taxes during the period of 2014-2019 - the same years Mr. Dubinskyi worked at 1+1 TV Channel for oligarch Igor Kolomoyskyi. It is obvious that pensioner Alla Berezovska did not have legitimate sources of income to acquire 12 apartments and parking boxes for 252 sq metres in 2015-2019. 

WESTERN ASSETS

While Oleksandr Dubinskyi publicly spreads anti-West propaganda in Ukraine and frequently attacks independent institutions, which are pillars of cooperation between Ukraine and the EU, he has assets in the EU member state - Slovakia. Part of these assets he does not declare.

In his annual asset declaration Oleksandr Dubinskyi declared a bank account in Tatra Banka, Bratislava, where he has 4278 Euro.

In addition to that Oleksandr Dubinsky declared unknown purchases in Slovakia, which were made on 01.03.2019 and on 31.05.2019 on the amount of 153 312 UAH (approx 6 000 USD) and 628 318 UAH (24 300 USD) respectively.

According to the information from Slovakian Business register, from March 30, 2019 until February 14, 2020 Oleksandr Dubinskyi was a sole shareholder of the Slovakian company DubPro s.r.o with share capital 5000 Euro. From February 18, 2020 Lesia Tsybko, the wife of Oleksandr Dubinskyi, became the company's shareholder. On September 19, 2020 the name of the company was changed on TsybPro S.r.o. However, Oleksandr Dubinskyi in his annual asset declaration for the year 2019 Mr.

Dubinskyi fails to declare his ownership rights in the Slovakian company thus violating Ukrainian anti- corruption law.

In addition to that on September 18, 2020 Lesia Tsybko registered one more company in Slovakia, called DT Consulting s.r.o.The share capital of the company is 5000 Euro and the economic activities are advertising and marketing research, administrative services, retail and brokerage activity.

ATTACKS ON INSTITUTIONS

Since the very first days of his work in the parliament Oleksandr Dubinsky started to initiate legislative proposals targeting institutions which are core pillars of Ukraine's cooperation with the IMF and the EU. Among institutions which Oleksandr Dubinskyi attacked are the following:

The National Bank of Ukraine, which in late 2016 nationalized the Privatbank. State-owned enterprises, including the current leadership of the nationalized Privatbank. Privatbank now has foreigners as professional managers of the institution. Under this independent management Privatbank launched a set of civil claims in the UK, USA and other countries aimed at recovering billions of dollars embezzlement by the bank's former beneficial owner - Igor Kolomoyskyi.

The National Anticorruption Bureau of Ukraine, which since late Autumn 2019 took over investigation of embezzlement of $5 bln from Privatbank by Igor Kolomoyskyi

Independence of the National Bank of Ukraine, the National Anticorruption Bureau of Ukraine and international standards of managing state-owned enterprises are crucial pillars of Ukraine-EU and Ukraine- IMF cooperation.

Mr. Dubinskyi in liaison with Kremlin agents like Andriy Derkach is conducting a blackmailing campaign against Ukrainian watchdog organizations and reformers within Ukrainian government and parliament, who were civil activists in the past. He is spreading disinformation about "Soros children" and "grant eaters" from civil society organizations, who are allegedly "embezzling foreign assistance funds" and thus harming the sovereignty of Ukraine.

Mr. Dubinskyi has lodged certain constitutional appeals against officials and institutions, whose decisions and/or actions harmed the interests of oligarch Kolomoyskyi.

Below is the detailed list of detrimental parliamentary initiatives and constitutional appeals of Oleksandr Dubinskyi:

On November 7, 2019

Mr. Dubinskyi initiated and registered draft parliamentary regulation to dismiss NABU Director Artem Sytnyk and was publicly pushing for this decision despite parliament lacking powers to dismiss NABU Director.

On February 12, 2020

Mr. Dubinsky submitted an appeal on unconstitutionality of certain provisions of the Code of Administrative Justice as well other laws. Andriy Derkach was among signatories of the respective appeal. It seems that the main goal underlying this appeal was to block proper functioning of the Deposit Guarantee Fund as well as to block certain decisions of the National Bank through the decisions of administrative courts. Both the National Bank and the Deposit Guarantee Fund had played a crucial role in successful and swift nationalisation of the Privatbank, so such claims seem to be a part of a retaliation campaign of the oligarch and his team. The CCU terminated consideration of this appeal in August 2020 after the substantial amendments of the provisions contested by Dubinskyi and other MPs.

On March 3, 2020

Mr. Dubinskyi initiated and registered a draft parliamentary regulation to have a no-confidence vote to Prosecutor General Rouslan Riaboshapka. On March 6 parliament supported this regulation and fired Rouslan Riaboshapka.

On March 5, 2020

Mr. Dubinskyi registered amendments to the Law on NABU introducing additional grounds to dismiss NABU Director, specifically for committing administrative offense.

On March 17, 2020

Oleksandr Dubinskyi with Andriy Derkach registered a draft law forbidding NGO activists and foreigners to be members of steering committees of state-owned companies.

On April 14, 2020

Oleksandr Dubinskyi registered draft law introducing prohibition for persons who either have or have had foreign citizenship to be appointed at managerial positions within state-owned military enterprises, specifically Ukroboronprom concern.

On May 20, 2020

Oleksandr Dubinskyi signed the constitutional appeal challenging the Presidential decree on appointment of NABU Director Artem Sytnyk. This appeal was also signed by Andriy Derkach and other prorussian MPs as well as certain MPs from the Servant of People party and small factions with ties to oligarchs. The goal of this claim was to undermine the legitimacy of Artem Sytnyk as a NABU Director and try to use this opportunity to dismiss him.

On May 29, 2020

Oleksandr Dubinskyi registered a draft law about transparency of NGOs with international fundings. According to the draft law NGOs with funding from foreign technical assistance projects should have information about "international support" marking in their legal names, submit additional financial reports to the tax offices and publish these reports on their websites. Members of the NGOs are not allowed to be public servants during 5 years and the leaders of the NGOs should have polygraph tests.

On June 11, 2020

Mr. Dubinskyi supported appeal on unconstitutionality of the recent Law on Amendments to the Certain Legal Acts on Improving Mechanisms for Regulation of Banks Functioning (also known as "Anti-Kolomoyskyi Law"). This Law was adopted in May 2020 as a part of the IMF conditionality for disbursement of the macro financial assistance loans. Its main goal is to prevent restitution of Privatbank to the previous owners. Adoption of this Law was strongly opposed by Kolomoyskyi and his cronies. Declaration of unconstitutionality of this Law could open the way for return of Privatbank to the previous owners or for enormous compensation payments to the previous owners.

On July 21, 2020

Another constitutional claim was submitted regarding the unconstitutionality of certain provisions of the Law on NABU. It was also supported by Andriy Derkach and prorussian MPs from the "Opposition Platform - For Life'' party. During the consideration of this appeal at the Constitutional Court of Ukraine the claim was changed and one of the MPs asked for recognizing unconstitutionality of the entire Law on NABU - in this case it could block the functioning of NABU. This scenario was avoided though. It seems that the motivation for submission of this claim had been to dismiss current NABU Director

On July 27, 2020

Oleksandr Dubinskyi registered a draft law introducing requirements for non-profit organizations which receive funding from foreign technical assistance projects to publish detailed reports about members of the organization, its revenue and expenditures. The draft law introduces tax restrictions for private enterprises which provide services to such NGOs and envisions lifting non-profit status for organizations which will not comply with new disclosure rules.

On August 7, 2020

Dubinskyi initiated a claim on unconstitutionality of the Grand Chamber of the Supreme Court. Before that, in June, Supreme Court judges adopted a decision in favor of the nationalized Privatbank, Ukrainian Government and the National Bank of Ukraine in the proceeding against Surkis brothers - they had submitted an appeal against "bail-in" procedure. In a worst-case scenario, after the recognition of certain provisions unconstitutional, it could open the way for review of the previous judicial decisions of the Grand Chamber, inter alia, in Surkis case, under the exceptional circumstances.
